The latest guidance from HMRC on the 30th November 2023 made specific reference to Key Information Documents (KiD), acting as a reminder to Employment Businesses that they need to get this right.


Borderless often see new customers whose systems don’t reliably produce these, or in some instances just aren’t aware of these obligations. With that in mind, we have produced a brief summary to help you stay compliant.


What is a KiD?

Introduced in 2019, as an addendum to the Conduct of Employment Agencies and Employment Businesses. In short, it is designed to ensure that workers understand their pay arrangements, who their employer is, and details of any fees or deductions.


Who is responsible?

The Employment Agency or Business is governed by the Conduct Regulations, and is therefore the responsible party. This is reinforced by the latest HMRC guidance. The regulations make it clear that this must be given to a worker at the point of engagement. If you have workers who haven’t received this properly, you must act as quickly as possible to rectify this.


What must it include?

Worker name (not mandatory)

Employment Status (contract for services, contract of employment, self employed subcontractor etc)

Rate of pay (this can be given as a minimum where you are unsure)

Frequency of pay

All deductions reporting through RTI (PAYE, National Insurance, Student or Post Grad loans)

All other deductions (umbrella margin, private healthcare etc)

Holiday Pay details


As well as this, it must include an example of Gross to Net conversion, based on all of the above. A sample payslip is a good way to do this.
